These Terms of Use (“Terms”) govern your access to and use of the Intellitory mobile application, website, and related services (collectively, the “Services”) provided by Intellitory, LLC (“Intellitory,” “we,” “us,” or “our”).

By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree to these Terms, do not use the Services.

The Intellitory Service

Intellitory provides technology designed to assist users with documenting, organizing, maintaining, and exporting information concerning personal property.

Features may include photo uploads, AI-assisted item identification, inventory organization, categories, quantities, descriptions, room information, user-entered values, reports, exports, and related functionality.

Features may vary by plan, platform, location, or stage of product development.

Eligibility and Accounts

You must be legally capable of entering into these Terms to create and use an Intellitory account.

You agree to provide accurate account information and to maintain the confidentiality and security of your login credentials.

You are responsible for activity occurring through your account except to the extent caused by Intellitory's failure to comply with applicable obligations.

You must promptly notify Intellitory if you believe your account has been accessed without authorization.

Your Inventory Information and Content

You retain ownership of photographs, inventory information, descriptions, and other content that you submit to Intellitory (“User Content”).

You grant Intellitory a limited right to host, store, copy, transmit, process, analyze, and otherwise use User Content only as reasonably necessary to provide, secure, maintain, support, and improve the Services and as otherwise described in our Privacy Policy.

You represent that you have the necessary rights to submit User Content to the Services and that your use of the content through Intellitory does not violate applicable law or the rights of another person.

Photographs and AI-Assisted Analysis

Intellitory may use artificial intelligence and automated technologies to analyze photographs and other information submitted by users.

AI-generated information is provided as an assistive tool and may contain errors. Object identification, descriptions, categories, quantities, values, or other generated information may be incomplete, inaccurate, or inappropriate for a particular purpose.

You are responsible for reviewing and confirming inventory information before relying on it.

Intellitory does not guarantee that artificial intelligence will identify every object visible in a photograph or correctly identify, categorize, describe, count, or value an item.

Not an Insurance Appraisal or Guarantee of Coverage

Intellitory is an inventory-documentation tool. Unless expressly stated otherwise for a specific service, Intellitory does not provide insurance, insurance adjusting services, professional appraisals, legal advice, tax advice, or guarantees concerning insurance coverage.

Creating an inventory through Intellitory does not guarantee that an insurer will accept an item, description, photograph, valuation, or claim.

Insurance coverage and claim determinations are governed by the user's insurance policy and the applicable insurer's claims process.

Users should retain receipts, appraisals, serial numbers, purchase records, photographs, and other documentation appropriate for valuable property when available.

User-Entered and Estimated Values

Where the Services permit users to enter, store, or review monetary values, those values should not be treated as certified appraisals unless expressly identified otherwise.

Users are responsible for verifying values used for insurance, estate, tax, financial, legal, or other purposes.

Plans and Access

Intellitory may offer different service plans with different functionality, storage limits, access periods, or other restrictions.

Certain plans may provide access for a limited period. When an access period expires, some functionality may become unavailable or read-only.

Expiration of an access period does not necessarily mean that User Content is immediately deleted.

Applicable plan features, limits, pricing, renewal terms, and access periods will be presented through the Services or applicable purchase interface.

Paid Services

Intellitory may offer paid features, one-time purchases, or subscriptions.

Pricing, billing frequency, renewal terms, cancellation options, and other purchase terms will be disclosed before purchase.

Purchases made through an application marketplace may also be subject to the applicable marketplace's payment, subscription, cancellation, and refund policies.

Unless otherwise required by law or expressly stated at the time of purchase, fees are non-refundable except as provided through the applicable marketplace or payment provider.

Acceptable Use

You may not use the Services to:

Violate applicable law;
Infringe another person's intellectual-property, privacy, or other rights;
Upload malicious software or harmful content;
Attempt to gain unauthorized access to accounts, systems, or infrastructure;
Interfere with the operation or security of the Services;
Circumvent plan restrictions, storage limits, authentication controls, or security measures;
Use automated systems to access the Services in a manner that materially burdens or disrupts them;
Reverse engineer the Services except where such restriction is prohibited by law; or
Use the Services for fraudulent, deceptive, abusive, or unlawful purposes.

Intellectual Property

Except for User Content, the Services and their associated software, interfaces, designs, graphics, branding, documentation, technology, and other materials are owned by or licensed to Intellitory and are protected by applicable intellectual-property laws.

“Intellitory,” its logos, and associated branding may not be used without authorization except as permitted by law.

These Terms do not transfer ownership of Intellitory's intellectual property to you.

Availability and Changes to the Services

We may modify, update, suspend, discontinue, or replace features of the Services as the product evolves.

We do not guarantee that every feature will always be available or that the Services will operate without interruption or error.

Where reasonably practicable, we will seek to avoid changes that unnecessarily prevent users from accessing or exporting their information.

Account Suspension and Termination

We may restrict or suspend access to the Services when reasonably necessary to protect the Services, other users, Intellitory, or third parties; investigate suspected fraud, security incidents, or violations; comply with law; or enforce these Terms.

Users may stop using the Services at any time and may request account deletion as described in our Privacy Policy and available account controls.

User Responsibility for Important Records

Although Intellitory uses systems designed to store and protect user information, users should maintain independent copies of important records.

Intellitory should not be used as the sole repository for irreplaceable receipts, appraisals, legal documents, financial records, photographs, or other critical information.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

INTELLITORY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT AI-GENERATED RESULTS WILL BE COMPLETE OR ACCURATE.

NOTHING IN THESE TERMS EXCLUDES WARRANTIES, RIGHTS, OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INTELLITORY, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INTELLITORY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO INTELLITORY FOR THE SERVICES DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

Some jurisdictions do not permit certain limitations of liability, so some of these limitations may not apply to you.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Intellitory, LLC and its officers, members, employees, contractors, and agents from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or User Content that infringes another person's rights.

Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

Nothing in these Terms prevents a consumer from exercising rights or remedies that cannot lawfully be waived.
